Meeting Minutes MICHIGAN TOWING ASSOCIATION JUNE 9, 2010 GENERAL MEETING The meeting was held at Genitti’s Hole in the Wall. The meeting was called to order at 7:10 p.m. President Bill Giorgis thanked everyone for coming and then introduced Doug Bryant of Kapnick Insurance, who introduced our speaker for evening. David Bose of Great West Casualty explained what CSA 2010 is and how it affects towing companies. The kick off is going to be in November 2010. Previously drivers changed companies and there was not much a company could do to check a driver’s record. Under CSA 2010 the driver is held accountable for their actions. Under CSA 2010 the DOT will do a lot of inspecting from their desk. The DOT just does not have enough man power to see every carrier. Violations for a driver are going to stay with the driver, not stay with the carrier as they do now. CSA 2010 will bring all tickets and truck inspections into one accessible system and give good and bad reports numbers. With this number system the DOT will send out warning letters if the points get too high and explain how to bring the numbers into a more acceptable level. You as a carrier can look up you score on the internet. If you ignore the warnings (letters and e-mail) the investigators will come and visit. CSA 2010 is going to use a uniform inspection. It uses all safety road side inspections, unsafe driver habits and it will yield more carrier inspections. If you have an inspection gets the results in writing. If you pass inspection be sure it is written up. If you do not have enough inspections you will be given a high number to trigger an inspection. If you disagree with an inspection result you can try to get it straightened up. There are 7 on road safety performance areas: unsafe driving, fatigued driving (hours of service) driver fitness, controlled substance, vehicle maintenance, cargo related and crash indicator. In order to get driver’s physical, you will have to go to a certified doctor not just any doctor. Intrastate carriers will not be affected currently unless already regulated. All enforcement personnel are going to be trained to inspect, not just told to go out and do the job. Intervention has 3 parts: early contact, warning letter; carrier access to safety date and measurement; and targeted roadside inspection. Second is investigation this will be offsite investigation, onsite investigation – focused and onsite investigation comprehensive. Then there is follow up cooperative safety plan, notice of violation, notice of claim and operations out of service. Always get inspection data in writing. If you believe something from an inspection is wrong you should challenge to get it changed, you can challenge at data q. Drivers can also challenge data. For pre-employment screening the driver must provide written consent to inspect their driving record. Under CSA 2010 points will stay on for 24 months for carriers and 36 months for drivers. Peer grouping will be done by the number of power units.
